Last April 28, with a search warrant, the FBI entered the apartment of Dr. Rudy Giuliani, former President Trump’s lawyer, and seized several of his electronic devices within an alleged connection between him, Trump, and Ukrainian officials.
“I’m very upset about what’s going on with Rudy Giuliani,” Dershowitz said to open his appearance with John Catsimatidis. “In banana republics, in Castro‘s Cuba, in many parts of the world when a candidate loses for president, they go after the candidate, they go after his lawyers, they go after his friends.”
“That didn’t happen in America, and that’s happening in America now. They’re going after Rudy Giuliani … Who knows who’s going to be next?” expressed the professor who also defended Trump in the Democrats’ first sham impeachment attempt.
According to Breitbart, federal agents raided Rudy Giuliani’s Manhattan home and office Wednesday and seized computers and cell phones in a major escalation of the Justice Department’s investigation into the business dealings of former President Trump’s personal lawyer.
Giuliani said the raid, which occurred at 6 a.m. and involved seven FBI agents, was unnecessary because he volunteered for two years to provide federal prosecutors with his electronic devices.
The former New York City mayor explained that neither the Justice Department nor the FBI has told him what the investigation is all about and that they have been after him for two years.
Certainly, the way the DOJ and FBI have acted since Joe Biden took over as president is starkly different from when Trump was in the White House.
Dershowitz explained that it is not legal to use a search warrant, which is usually used to search places for evidence of a crime, in a case like Dr. Giuliani’s.
“A search warrant on a lawyer or a doctor or a priest? You don’t use search warrants when people have privileged information on their cell phones and in their computers. You use a subpoena. The difference between a subpoena and a search warrant is like night and day,” the Harvard professor explained.
“It’s just not constitutional,” he continued. “And that’s why when Rudy called me yesterday, I said sure I’ll help out. I’m in favor of the Constitution.”
According to AP reports, the investigation into Dr. Giuliani is related to when he served as Trump’s personal attorney and they established contact with Ukrainian officials to investigate the corrupt ties of Hunter Biden. At the time, his father, Joe Biden, was the United States Vice President in the Obama administration.
The Justice Department accuses the former mayor of failing to register as a ‘foreign agent’ and making false claims about Joe Biden and Ukraine during the 2020 presidential campaign.
However, there is a video of Joe Biden bragging at a press event that he demanded the prosecutor investigating his son Hunter about his position on the board of the Burisma company be fired. If not, Ukraine would not receive U.S. financial aid, a clear violation of his position as vice president.
One theory as to why they are after the former mayor is because he has been the public face of allegations of voter fraud in the 2020 presidential election, something Democrats want to bury in the past at any cost.
But the cost of illegally going after Trump supporters could be the case that the loss outweighs the benefit.

“Look, I think the government made a serious mistake when they went by search warrant. They gave Rudy Giuliani lots of legal arguments … that I think he can prevail on. … Apparently, they went after the cloud and went after other material and information without telling him. That’s just not the way the government is supposed to treat its citizens.”
