Despite only being approved for emergency use, the Department of Justice (DOJ) published an opinion on Monday, July 26, saying that coronavirus vaccine mandates are legal.

The Food and Drug Administration’s (FDA’s) emergency use go-ahead “does not prohibit public or private entities from imposing vaccination requirements for vaccines that are subject to EUAs,” the DOJ’s Office of Legal Counsel wrote.

Citizens have a right to be “informed” of certain information, including “the option to accept or refuse administration of the product,” according to the DOJ. Nevertheless, businesses, governments, and other entities are not prohibited from requiring doses from Pfizer, Moderna, or Johnson & Johnson, which have all received only emergency use authorizations, the Washington Examiner reported.

On Monday, the U.S. Department of Veterans Affairs, California, and New York City is the first federal agency to announce that some or all of their government employees would be required to be vaccinated or tested weekly. The FDA has yet to give the vaccines their final approval.

“As access to the COVID-19 vaccines has become widespread, numerous educational institutions, employers, and other entities across the United States have announced that they will require individuals to be vaccinated against COVID-19 as a condition of employment, enrollment, participation, or some other benefit, service, relationship, or access,” DOJ’s Office of Legal Counsel wrote in an opinion. “For instance, certain schools will require vaccination in order for students to attend class in person, and certain employers will require vaccination as a condition of employment.”

Also, on Monday, Mayor Bill de Blasio of New York City stated that all city workers would be required to be vaccinated or submit to weekly virus testing. The law, which goes into effect in September, will affect approximately 340,000 workers, teachers, and police officers.

“September is the pivot point of the recovery,” the Democratic mayor said at a press conference on Monday. “And so, on Sept. 13, the first day of school, every single city employee will be expected to be either vaccinated or be tested weekly.”

During a White House press briefing last week, press secretary Jen Psaki stated that every White House official had been offered the COVID-19 vaccine, but she later emphasized that the White House did not require officials to get the vaccine.

“No, we have not mandated it,” Psaki responded after being questioned if the administration was requiring White House personnel to get a coronavirus vaccine.
